Marbury v. Madison, 5 U.S. (1 Cranch) 137 (1803), is a landmark case in the history of the United States Supreme Court. It established the principle of judicial review, which gives the Court the power to declare acts of Congress unconstitutional. The case arose from the political tensions and power struggles between the Federalist and Democratic-Republican parties in the early 19th century.
In 1800, President John Adams appointed William Marbury as a justice of the peace in the District of Columbia. However, Marbury's commission was not delivered before Adams left office, and the new Secretary of State, James Madison, refused to deliver it. Marbury then petitioned the Supreme Court for a writ of mandamus, which would compel Madison to deliver the commission.
Chief Justice John Marshall, writing for the Court, held that Marbury had a legal right to his commission, and that the Judiciary Act of 1789 gave the Court the authority to issue a writ of mandamus. However, Marshall also ruled that the provision of the Judiciary Act granting the Court this power was unconstitutional, as it expanded the Court's original jurisdiction beyond what was specified in the Constitution.
